Divorce mediation an option for New Yorkers in family law dispute

It happens roughly 50 percent of the time. A married couple, once happy, has found that it is in their best interests to go separate ways. People change and there are many things that could bring about the end of a marriage, and the matter is rarely easily put to rest. When there are children involved it often can be more complicated. Yet, there are ways to discuss the issue and perhaps come to an agreement on family law issues such as child custody and property division.

One such way is to approach divorce through a process called divorce mediation. Divorce mediation, like litigation, can result in final decisions regarding divorce issues like property division and child custody. However, it is different in its processes. During mediation, there is an open discussion about the matters at hand, which tends to decrease the levels of emotional stress. The mediator remains neutral while parties have their attorneys present..

This method of mediation is often a more healthy way to go about divorce proceedings. This is because the method seeks to reach resolutions through healthy discussion and reasoning. This can be great news for kids because instead of putting the parents in a one-wins/one-loses situation the parents can amicably discuss child custody arrangement in a way that might benefit children the most. Less arguing usually leads to less stress and a better environment for the child at hand.

There has been an increase in divorce mediation in recent years. This is due to many reasons, a few of those being cost comparison, communication ability, and child environment differences. However, mediation is not a quick-fix for divorcing couples who are not communicating. Both parties will need to show up to the mediation with an open and level head in order for the mediation to be a success.
