Securing child support for children's financial needs

People in New York who have children know that raising them can be expensive. They need food, clothing and shelter, but that is just the basics. There are medical needs, extracurricular activities, entertainment and many other expenses. These expenses are there whether the parents are married or divorced. However, when parents are divorced it can be a little more difficult to figure out how to ensure both parents contribute to these expenses.

To help ensure that these expenses are shared, child support is mandatory in every divorce with children. It cannot be waived by the parents. It is generally determined according to the Child Support Standards Act, but there are many variables involved in determining the amount of each parent's income.

Not every parent works for a company and receives a W-2 at the end of the year. Some are self-employed and own their own business. Determining self-employed people's income can be much more complicated. Despite the complications that can arise it is important for the child to ensure that the parent's true income is used when determining the amount of the child support.

Parents may also be able to deviate from the standard amount depending on the circumstances of the specific case. There are other costs that the parents must share as well such as child care costs and medical costs that are not included when determining the amount of basic child support.

As one can see, determining child support in New York is much more complicated than it may seem at first glance. It is important to determine the proper amount of child support and these are very fact specific matters. At our firm we have handled many child support matters and understand the importance of child support for the child. We understand that the specific facts of each case are unique and treat them as such. For more information on child support in New York, please visit our child support page on our website.
